Can someone demand a replacement of their car if it is NOT deemed “totalled”?
I was in a very minor 15 mph accident which was found to be my fault. I have a subaru forester, and the other party was driving a merecedes slr mclaren (i know nothing about cars, but i’m told its VERY expensive and rare). my damage was an $800 dent, and his damage was a 5in hairline crack. apparently, this car is made from carbon fiber-glass and regular body shops/dealers are not equipped/authorized to repair it. my insurance company thinks they have found a specialized race-car body shop that could repair it; they are getting an estimate on the damage now. however, now the other party is coming back demanding that we replace his car since that lil crack has ruined the true value of his car. can he do this? my ins. co. is trying to fight him, but if they won’t pay, can he come after me/my family? PLEASE HELP!
Don’t worry about it. Your insurance company will represent you in anything that happens, and you are only required to make the person whole by restoring their vehicle to pre-accident condition, not to replace their vehicle. “Diminished value” is something that the insurance company will not even listen to unless there is proven diminished value, not just perceived diminished value, which is almost impossible to prove. Just let his insurance company fight with yours. If they call you directly, just refer them to your insurance company.
