my sister totaled my car.. both of us have liability insurance, shouldnt she be “liable”?
she was convinced she had full coverage (she lives in minnesota) i live in NH and she took it to see my mother 60 miles away. she ran it off the road and into some trees… long story short, its wrecked up pretty good and her insurance is claiming that because she only had liability, they will not pay for it.
i would believe that liability covers damage that her as a driver does to any vehicle that she doesnt own.
its a 97 Subaru/Alcyone SVX (only 640 of them were made). do i have some argument?
Unfortunately for you, liability insurance covers damage that the CAR causes to others’ property . . . not damage that the DRIVER causes. Damage to the car itself always requires some amount of collision insurance. This is true whether the owner is actually the driver, or if the car is loaned out.
So in this case, you and your sister are somewhat protected if someone wanted to sue you over damaged trees. But the car itself is not covered . . . at least by her insurance.
